Agreement to Terms

By accessing or using the Magnesium Athletes mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Magnesium Athletes provides a mobile commerce platform for purchasing transdermal magnesium recovery products. The App allows you to:

Browse our product catalog
Add products to your cart
Complete purchases through Shopify's secure checkout
Track your orders
Access product information and recovery resources

Account and Registration

No Account Required

The App does not require account creation for browsing or purchasing. However, you must provide accurate shipping and contact information to complete a purchase.

You agree to provide accurate, current, and complete information during the checkout process. You are responsible for maintaining the accuracy of this information.

Purchases and Payments

Product Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion.

Pricing

All prices are listed in USD and are subject to change without notice
Prices do not include shipping costs unless otherwise specified
We reserve the right to correct pricing errors

Payment Processing

Payments are processed securely through Shopify
We accept major credit cards, debit cards, and other payment methods as displayed during checkout
By providing payment information, you authorize us to charge your payment method for the total amount of your order

Order Confirmation

You will receive an email confirmation when your order is placed. This confirmation does not constitute acceptance of your order. We reserve the right to cancel orders for any reason, including product unavailability or pricing errors.

Shipping

Shipping times and costs vary based on your location and selected shipping method
Risk of loss transfers to you upon delivery to the carrier
We are not responsible for delays caused by shipping carriers

Trademarks

"Magnesium Athletes" and our logo are trademarks of Magnesium Athletes. You may not use these trademarks without our prior written permission.

User Conduct

You agree not to:

Use the App for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with the proper functioning of the App
Collect information about other users
Transmit viruses, malware, or other harmful code
Impersonate any person or entity
Use automated systems (bots, scrapers) to access the App

Product Information and Disclaimers

Health Information

Not FDA Evaluated

Limitation of Damages

IN NO EVENT SHALL MAGNESIUM ATHLETES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Magnesium Athletes and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Any products purchased through the App

Third-Party Services

Shopify

Payment processing and checkout are provided by Shopify. Your use of Shopify's services is subject to Shopify's Terms of Service at https://www.shopify.com/legal/terms

Google Services

The App uses Google Places API and Firebase. Your use of these services is subject to Google's Terms of Service at https://policies.google.com/terms

Third-Party Links

The App may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of third-party websites.

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Termination

By You

You may stop using the App at any time by deleting it from your device.

By Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

Effect of Termination

Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

Dispute Resolution

Governing Law

These Terms are governed by the laws of Texas, without regard to conflict of law principles.

Arbitration Agreement

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Texas.

Class Action Waiver

You agree to resolve disputes on an individual basis only and waive any right to bring or participate in class actions or class arbitrations.

Exceptions

You may bring claims in small claims court if they qualify. Either party may seek injunctive relief in court to protect intellectual property rights.

General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Magnesium Athletes regarding the App and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

Notices

We may provide notices to you via email, in-app notifications, or by posting on our website. You consent to receive electronic communications.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Updating the "Last Updated" date
Providing an in-app notification
Sending an email (if you have provided one)

Your continued use of the App after changes constitutes acceptance of the modified Terms.
